Subcommittee B of the Committee on Banking and Insurance moves
to amend the bill on page one, by striking out everything after the
enacting clause and inserting in lieu thereof the following:
"That §18B-11A-2 of the Code of West Virginia, 1931, as
amended, be amended and reenacted: that said code be amended by
adding thereto two new sections, designated sections §18B-11A-8
§18B-11A-9, all to read as follows:
ARTICLE 18B. HIGHER EDUCATION.
18B-11A-2. Definitions.
For the purposes of this article:
(1) "Autism Spectrum Disorder" means one or more or a
combination of the following neurobiological conditions: Autism,
Asperger syndrome, and Retts syndrome.
(a) (2) "Board" means the Marshall University board of
governors;
(b) (3) "Center" means the autism training center;
(c) (4) "Client" means a person with the primary diagnosis of
autism or autistic-like behavior; and
(d) (5) "Expenses" means those reasonable and customary
expenditures related to training and treatment of eligible clients
as defined in the rules and regulations promulgated by the center.
18B-11A-8. Legislative Findings.
(a)The Legislature finds that:
(1)Research indicates that early diagnosis and intervention
for Autism Spectrum Disorder is critical for success in treatment.
(2) There is a need in West Virginia for availability of
evidence-based treatment for Autism Spectrum Disorder.
§18B-11A-9. Duties of State Autism Training Center and West
Virginia University Center for Excellence in Disabilities.
The State Autism Training Center and the West Virginia
University Center for Excellence in Disabilities shall use such
additional moneys as may be provided upon appropriation of the
Legislature to improve the delivery of services relating to early
diagnosis, intervention and treatment for Autism Spectrum Disorder
in this state."
